Terms of Service

These Terms of Service ("Terms") govern your use of PawsDear, a pet memorial service operated as PawsDear ("we", "us", "our"). By creating an account, activating a Physical ID, or using our website at pawsdear.com, you agree to these Terms.

1. The service

PawsDear lets pet owners create memorial pages, collect letters and tributes from family and friends, store photos, audio, and video links, and optionally link a Physical ID (tag) for expanded storage and long-term hosting. Guest content may be submitted through Dear Mail (email to a memorial address) or through the public page, subject to owner settings.

2. Accounts and activation

You must provide a valid email address to register or activate a memorial. You are responsible for activity under your account and for keeping access to your email secure. Activation of a Physical ID connects that tag to a memorial page under your owner account.

3. Your content

You retain ownership of content you upload or approve (photos, text, audio, and similar materials). You grant us a limited license to host, display, back up, and deliver that content as needed to operate the service—including in exports you request (such as PDF keepsakes or webpage backups).

You must have the rights to any content you post. Do not upload material that infringes others' rights, contains malware, or violates applicable law.

4. Guest and third-party content

Letters, tributes, and Dear Mail messages from others may appear on your memorial. You can use owner tools to approve, hide, or delete content where the product allows. Embedded third-party media (for example YouTube) is subject to the provider's terms and policies.

5. Acceptable use

You may not use PawsDear to harass others, distribute spam, attempt unauthorized access, scrape the service at scale, or use memorial pages for unrelated commercial advertising. We may suspend or remove content or accounts that violate these Terms or harm the service or other users.

6. Storage, tiers, and limits

Free and tagged memorials have different limits on photos, audio, mailbox space, and related features. Limits are described on the website and may change; we will apply changes reasonably and in line with product updates.

7. Availability and disclaimers

The service is provided "as is" and "as available." Memorial pages depend on internet hosting; we strive for reliability but do not guarantee uninterrupted access. Tagged memorials include long-term hosting commitments described on the marketing site; offline backups and exports are provided as tools for you to keep your own copies.

8. Limitation of liability

To the fullest extent permitted by applicable law, PawsDear and its operators are not liable for indirect, incidental, special, or consequential damages, or for loss of data except where liability cannot be excluded by law. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim (or USD $50 if you used only free features).

9. Termination

You may stop using the service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the service. Upon termination, public pages may be disabled; export tools may be offered where technically feasible.

10. Changes

We may update these Terms. We will post the revised Terms on this page and update the effective date. Continued use after changes constitutes acceptance of the updated Terms.

11. Governing law

These Terms are written in English. Any dispute is subject to the laws applicable in your jurisdiction, without regard to conflict-of-law rules, except where mandatory local consumer protections apply.
